Official Promotional Rules
A complete copy of these rules can be obtained at the offices of radio station WWWQ-FM/Q100 (the “Station”) owned and operated by Susquehanna Radio Corp., a wholly owned subsidiary of Cumulus Media Partners LLC, 780 Johnson Ferry Rd., 5th Floor, Atlanta, GA 30342, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.
The Station will conduct the Q100 $10,000 Free Money Fugitive (the “Contest”) substantially as described in these rules, and by participating, each participant agrees listeners agree to be bound by these rules:
1. No purchase is necessary. Void where prohibited. All federal, state, and local regulations apply.
2. Contest is open only to legal U.S. residents who are of legal age 18 or older with a valid Social Security number at the time of entry. Employees, agents, representatives, or affiliates of the Station, Susquehanna Radio Corp., its parent and affiliated companies, participating sponsors, and their immediate family members and household members are not eligible to participate or win. The term “immediate family members” includes spouses, parents, siblings, grandparents, children, grandchildren and cohabiting significant others. In addition, the $10,000 Free Money Fugitive (hereinafter the “Fugitive”), his/her immediate family members, household members, and certain friends previously identified by the Fugitive in writing prior to the start of the Contest (collectively, “Fugitive Relations”) are not eligible to participate or win. The Fugitive Relations understand and agree that they will not know if they are ineligible to participate or win until the Fugitive’s identity has been revealed.
3. An individual may win an on-going contest only once per six-month period unless otherwise specifically stated. An individual may win other seasonal or one-time contests only once for the duration of the contest.
4. The Contest will begin on Thursday, September 17, 2009 and will continue until such time as the Fugitive is correctly identified in accordance with the Contest Rules set forth herein (the “Contest Period”). The Contest will be conducted Monday through Friday from 7:00am until 9:00pm EST (the “Contest Hours”). THE CONTEST CAN ONLY BE WON DURING THE CONTEST HOURS OF 7AM - 9PM, MONDAY THROUGH FRIDAY.
5. To participate in the Contest, listen to the Station during the Contest Period for clues as to the Fugitive’s identity and location. Clues will be announced at approximately 7:15am, 11:20am, and 5:20pm EST each weekday. Station reserves the right, in its sole discretion, to not announce a clue at any given time, to announce additional clues without prior notification, or to repeat clues. Clues may also be posted on the Station’s website www.q100atlanta.com.
6. To win the Contest, participants must use the clues provided by the Station to discern the location and identity of the Fugitive. The Fugitive will be located within the Metro Atlanta Area, which for purposes of this Contest is defined as Cobb, Clayton, DeKalb, Fulton and Gwinnett counties. Upon correctly locating and identifying the Fugitive, the participant must approach the Fugitive in person and, directly and in reasonably close physical proximity, ask the following question verbatim: “ARE YOU THE Q100 $10,000 FREE MONEY FUGITIVE?” In the event that two or more participants attempt to question the Fugitive at the same time, the Fugitive will determine, in his/her sole discretion, the participant who was first to correctly question the Fugitive. If the participant has correctly identified and questioned the Fugitive, the Fugitive will respond in the affirmative and provide to the participant a letter on Station letterhead signed by the Station’s Manager, Gary Lewis, which will contain a telephone number and secret password. To win the Contest and be eligible for the Grand Prize, the participant must within one (1) hour of receiving the letter call the telephone number and provide the secret password in the presence of the Fugitive. The first participant to correctly complete these steps will be eligible to win the Grand Prize.
7. One (1) person has been designated by the Station as the Fugitive. The Station reserves the right, in its discretion to designate an alternative person as the Fugitive. During the Contest Hours, the Fugitive will be always located in a public area and will be easy to access and/or approach. The Fugitive will not ask you to leave the public area in which the Fugitive is located. DO NOT FOLLOW THE FUGITIVE OUTSIDE OF A PUBLIC AREA OR ACCEPT A RIDE FROM ANYONE IDENTIFYING THEMSELVES AS THE FUGITIVE. ALWAYS STAY IN A PUBLIC AREA.
8. Absolutely no destruction of public or private property is necessary to find the Fugitive. Absolutely no risk taking is required to find the Fugitive. Anyone causing damage or destruction to persons or property, or causing any risk of injury or damage to themselves or third parties will be immediately disqualified from participating in the Contest. Participants are instructed to stay out of privately owned property or areas – DO NOT TRESPASS ON PRIVATE PROPERTY. Any participant found searching for the Fugitive on private land or using private land to access the Fugitive will be immediately disqualified from participation in the Contest.
9. The Fugitive may only be approached and questioned as set forth in these rules. If the Fugitive is approached and/or questioned in any of the following situations, or any other situation or manner that is not expressly permitted by these Contest Rules, the Fugitive will not identify him/herself as the Fugitive and the participant will not be eligible to win the Contest:
• The Fugitive is approached and/or questioned at a time that is not within the Contest Hours.
• The Fugitive is approached and/or questioned while the Fugitive is on private property, in a private residence or private place of accommodation, or traveling in private transport.
• The Fugitive is questioned over a public address system, broadcast equipment, or any other form of mass communication.
10. Time Delay Between Over-the-Air Analog Signal and Internet Broadcast: Due to the time delay that exists between the Station’s analog over-the-air signal and the Station’s online webcast, listeners who listen to the Station online may hear the cue to call later than listeners listening to the Station’s analog over-the-air signal. As a result, the odds of an online listener winning this Contest may be diminished.
11. One (1) Grand Prize will be awarded to the first eligible participant to correctly complete the steps set forth above. The Grand Prize consists of a company check made payable to the winner in the amount of $10,000.
12. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner. All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.
13. Odds of winning depend on a number of factors including the number of people participating in the Contest.
14. All prizes are awarded “as is.” Prizes are nontransferable and cannot be exchanged or sold. No substitute prize will be awarded to a winner who declines to accept a prize.
15. Neither the Station, Susquehanna Radio Corp., its parent or affiliated companies, and their directors, officers, employees, agents or representatives (collectively the “Station Parties”) shall be responsible for the failure of participating sponsors to deliver the prizes or any part thereof as described herein.
16. The Station cannot guarantee the safety of Contest participants. All participants and winners agree that the Station Parties shall have no liability for any injury, misfortune, or damage to either persons or property incurred by entering, participating in, winning, or losing any contest and/or by the use or non-use of any prize received in connection with this contest. Contest participants agree to indemnifying and hold the Station Parties harmless from any injury or damage to persons or property resulting from their own negligent acts and/or willful misconduct
17. All prizes must be claimed in person at the Station at the address identified above during regular business hours and within ten (10) business days of winning, excluding holidays. After such time, ownership of said prize reverts back to Station to be disposed of at its discretion. The winner then loses all claims and rights to said prize.
18. Two (2) forms of proper identification must be presented by any winner to claim prize. As a condition to receiving the prize, any potential winner must complete and sign a Winner’s Affidavit and Release, releasing the Station Parties from all liability in connection with winner’s participation in the Contest and acceptance, use, or non-use of the prize. Winner must also agree to participate in all publicity activity associated with the Contest, including, but not limited to, telephone, radio, TV or other media interviews, etc. for the duration of the Contest and a reasonable time thereafter.
19. All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of the Station to be used, disposed of or destroyed in its sole discretion. The Station Parties are not responsible for any incorrect or inaccurate information entered by website users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Station’s website.
20. All participants and winners agree to give the Station Parties, their licensees, affiliates, successors, and assigns the irrevocable and unrestricted right to use, re-use, broadcast, or publish their name, city of residence, photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched or distorted in character or form, and winner’s voice, recorded or live, for any reason the Station deems necessary without compensation, unless prohibited by law. All winners release, discharge, and agree to save harmless the Station Parties from any and all claims they may have against the Station Parties in connection with the taking, production, or the use of winners’ name, city of residence, any photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched, or distorted in character or form and without restrictions as to any changes, transformations or alterations, and including winners’ voices, recorded or live. All winners further acknowledge that the Station owns or will own exclusively any photographs of such winners used for such purposes, including the copyrights in them, regardless of the form in which they have been or may be produced and used, and all winners assign all such ownership rights to the Station.
21. All participants and winners agree to assist the Station in any investigation deemed necessary or appropriate to determine the legitimacy, legality or propriety of a participant’s Contest-related activities. This includes, but is not limited to, participating in interviews, submitting to one or more potential polygraph tests, and fully disclosing any relationship the participant may have with the Fugitive.
22. By participating in the Contest, participants agree to be bound by these Contest Rules and all decisions of Station personnel, including the Fugitive. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Station will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Station’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Station, the Station reserves the right to terminate this Contest, or make such other decisions regarding the administration or outcome as the Station deems appropriate. All decisions will be made by the Station are final, unappealable, and binding. The Station may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, STATION RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
23. The Station reserves the right to limit the number of times an individual may enter a contest or drawing.
24. A winners list may be obtained after November 30th, 2009, by sending a self-addressed stamped envelope to the following address: Q100 $10,000 Free Money Fugitive Winner List, 780 Johnson Ferry Rd., 5th Floor, Atlanta, GA 30342.
